パズルゲームアプリのご利用条件について

この利用規約（以下「本規約」）は、PUZZLIAR（以下「当方」）が提供するパズルゲーム 「削減アミダクジ PUZZLE」（Web 版および iOS／Android 版を含みます。以下「本サービス」）の 利用条件を定めるものです。本サービスを利用する方（以下「利用者」）は、本規約に同意のうえご利用ください。 本サービスを利用した時点で、本規約に同意したものとみなします。

第1条（適用）

  1. 本規約は、本サービスの利用に関する当方と利用者との間の一切の関係に適用されます。
  2. 当方が本サービス上で掲示するルール・注意事項・ヘルプ等は、本規約の一部を構成します。 これらと本規約の内容が異なる場合は、本規約が優先します。
  3. iOS 版・Android 版の利用には、Apple Inc. または Google LLC（以下「プラットフォーム事業者」）の 利用規約等も適用されます。

第2条（本サービスの内容）

  1. 本サービスは、リアル交渉ゲーム「削減アミダクジ」の盤面をもとにしたパズルゲームです。 基本的な機能は無料でご利用いただけます。
  2. 本サービスには、記録を他の利用者と比較できるオンラインランキング、および有償のアイテム（ハート）の購入機能 （iOS 版・Android 版のみ）が含まれる場合があります。
  3. 当方は、本サービスの内容（ステージ、ルール、ランキングの集計方法、アイテムの仕様等）を、 必要に応じて追加・変更することがあります。

第3条（アカウント）

  1. 本サービスでは、初回利用時に利用者ごとの識別子（ゲストアカウント、プレイヤー ID）を自動で発行します。 iOS 版・Android 版では、任意で Google または Apple のアカウントと連携することで、記録を別の端末へ引き継げます。
  2. アカウントと連携していない場合、端末の変更・アプリの削除・ブラウザのデータ消去等により、 記録や購入したアイテムを引き継げなくなることがあります。当方はこれを復元する義務を負いません。
  3. 利用者は、自己のアカウントを第三者に譲渡・貸与・売買してはなりません。
  4. 利用者は、本サービスのアカウント画面からいつでもアカウントを削除できます。 削除すると、記録・ランキング・購入履歴・未使用のハートを含むすべての情報が失われ、元に戻すことはできません。

第4条（未成年の利用者）

未成年の方は、親権者等の法定代理人の同意を得たうえで本サービスを利用してください。 特に有償アイテムを購入する場合は、必ず事前に法定代理人の同意を得てください。 法定代理人の同意を得て購入した場合、または成年であると偽って購入した場合は、 その購入を取り消すことはできません。

第5条（有償アイテム）

  1. iOS 版・Android 版では、ゲームに挑戦するためのライフを回復するアイテム「ハート」を有償で購入できます。 価格・数量は購入画面およびストアの表示に従います。
  2. 購入手続き・決済は、各プラットフォーム事業者の定める方法により行われます。 当方はクレジットカード番号等の決済情報を取得しません。
  3. ハートは、本サービス内でライフとして使用する権利であり、通貨・財産的価値を持つものではありません。 現金その他の財物との交換、他のアカウントへの譲渡はできません。
  4. ライフの上限（10）を超えてハートを保有することはできません。上限を超える購入はできないよう制御しています。
  5. 購入したハートは、法令またはプラットフォーム事業者の規約に基づく場合を除き、払い戻し・返品・キャンセルはできません。 払い戻しの可否・手続きは、購入したストアの定めに従います。
  6. 決済が完了したにもかかわらずハートが付与されない場合は、第14条の窓口へご連絡ください。 購入履歴を確認のうえ対応します。

第6条（ランキングと表示名）

  1. オンラインランキングには、利用者が設定した表示名・アイコン・記録が他の利用者に公開されます。 本名や連絡先など、個人を特定できる情報を表示名に用いないでください。
  2. 利用者は、第三者の権利を侵害するもの、公序良俗に反するもの、他人を誹謗中傷・差別するもの、 他人や当方になりすますもの、宣伝・勧誘を目的とするものを表示名・アイコンに用いてはなりません。
  3. 当方は、前項に該当する表示名・アイコン、または不正な手段で得られたと判断した記録を、 利用者に事前に通知することなく変更・非表示・削除できるものとします。
  4. ランキングの集計方法・公式記録の扱いは、本サービス上の説明に従います。 当方は、不具合の修正等のため、ランキングを集計し直し、またはリセットすることがあります。

第7条（禁止事項）

利用者は、本サービスの利用にあたり、次の行為をしてはなりません。

  • 法令または公序良俗に違反する行為
  • 本サービスのプログラム・通信・記録を改ざんする行為、リバースエンジニアリング、 自動操作ツール等を用いて記録やアイテムを不正に取得する行為
  • 本サービスの不具合を意図的に利用する行為、または不具合を知りながら当方に報告せず利用し続ける行為
  • 本サービスのサーバー・ネットワークに過度な負荷をかける行為、運営を妨害する行為
  • 複数のアカウントを用いてランキングを不正に操作する行為
  • アカウント・記録・アイテムを売買・譲渡し、またはその勧誘をする行為
  • 他の利用者・第三者・当方の権利や利益を侵害する行為
  • その他、当方が不適切と合理的に判断する行為

第8条（利用停止等）

当方は、利用者が本規約に違反した場合、または違反するおそれがあると合理的に判断した場合、 事前の通知なく、当該利用者の記録の削除、ランキングからの除外、本サービスの全部または一部の利用停止、 アカウントの削除を行うことができます。この場合、未使用のハートの払い戻しは行いません。

第9条（知的財産権）

本サービスに含まれるプログラム・デザイン・画像・文章・ゲームのルールおよび盤面等に関する著作権その他の知的財産権は、 当方または正当な権利者に帰属します。リアル交渉ゲーム「削減アミダクジ」の原作はラダ、監修は dai です。 利用者は、私的利用の範囲を超えてこれらを複製・改変・配布・公開してはなりません。 ただし、本サービスのシェア機能による記録の共有、およびプレイ画面のスクリーンショットや動画を 個人の SNS 等で紹介する行為は、営利目的でない限り自由に行っていただけます。

第10条（本サービスの変更・中断・終了）

  1. 当方は、システムの保守・障害・天災その他やむを得ない事由がある場合、事前の通知なく本サービスの全部または一部を 一時的に中断することがあります。
  2. 当方は、本サービスの全部または一部を終了することがあります。 その場合は、相当の期間をおいて本サービス上で事前に告知します。
  3. 本サービスの終了にともない、未使用のハートは失効します。 ただし、法令上払い戻しが必要とされる場合は、法令に従い対応します。

第11条（保証の否認）

当方は、本サービスがすべての端末・環境で動作すること、不具合や中断が生じないこと、 記録が失われないこと、および利用者の特定の目的に適合することを保証するものではありません。

第12条（責任の制限）

  1. 当方は、本サービスの利用に関して利用者に生じた損害について、当方の故意または重大な過失による場合を除き、 責任を負いません。
  2. 前項にかかわらず、当方と利用者との間の契約が消費者契約法に定める消費者契約となる場合で、 当方の過失（重大な過失を除きます）により利用者に損害が生じたときは、 当方は、通常生ずべき損害に限り、当該損害が生じた月を含む過去 12 か月間に利用者が本サービスに支払った金額を上限として賠償します。
  3. 前二項の規定は、当方の故意または重大な過失による損害については適用しません。

第13条（個人情報の取扱い）

本サービスにおける利用者の情報の取扱いは、当方のプライバシーポリシーに定めるとおりです。

第14条（お問い合わせ）

本サービスに関するお問い合わせ、ハートの付与に関するご連絡、記録の削除のご依頼は、info@puzzliar.jpまでメールでお送りください。記録に関するお問い合わせの際は、ランキングに表示している名前を添えてください。

第15条（本規約の変更）

当方は、民法第 548 条の 4 の規定に基づき、次の場合に本規約を変更することがあります。 変更する場合は、変更後の内容と効力発生日を、効力発生日の相当期間前までに本ページおよび本サービス上で告知します。

  • 変更が利用者の一般の利益に適合するとき
  • 変更が本規約の目的に反せず、変更の必要性、変更後の内容の相当性その他の事情に照らして合理的なとき

第16条（準拠法・管轄）

本規約は日本法に準拠し、日本法に従って解釈されます。本サービスに関して当方と利用者との間で紛争が生じた場合は、 東京地方裁判所を第一審の専属的合意管轄裁判所とします。 本規約の日本語版と英語版の内容に相違がある場合は、日本語版が優先します。

Sakugen Amidakuji PUZZLE — Terms of Service (English)

These Terms of Service (the “Terms”) set out the conditions for using “Sakugen Amidakuji PUZZLE” (including the web, iOS and Android versions; the “Service”) provided by PUZZLIAR (“we”). By using the Service, you agree to these Terms. This English version is provided for convenience; if it differs from the Japanese version, the Japanese version prevails.

1. Scope

These Terms apply to all use of the Service. Rules and notices shown in the Service form part of these Terms. For the iOS and Android versions, the terms of Apple Inc. or Google LLC also apply.

2. The Service

The Service is a puzzle game based on the board of the live negotiation game “Sakugen Amidakuji”. Its basic features are free. It may include online rankings and, in the iOS and Android versions only, paid items (“hearts”). We may add to or change the content of the Service.

3. Accounts

A guest account / player ID is issued automatically on first use. In the iOS and Android versions you may link a Google or Apple account to transfer your records to another device. Without linking, records and purchased items may be lost if you change devices, delete the app or clear browser data, and we are not obliged to restore them. You may not transfer, lend or sell your account. You can delete your account at any time from the Account screen; all records, rankings, purchase history and unused hearts will be permanently lost.

4. Minors

If you are a minor, obtain consent from your parent or guardian before using the Service, and in particular before making any purchase.

5. Paid items

Hearts restore lives used to play. Purchases and payments are handled by Apple or Google; we do not receive your payment details. Hearts are a right to use lives within the Service, have no monetary value, and cannot be exchanged for cash or transferred. You cannot hold more than the life limit (10). Except as required by law or by the store’s terms, purchases are non-refundable; refunds follow the rules of the store you purchased from. If hearts are not granted after payment, please contact us (Section 14).

6. Rankings and display names

Your display name, icon and records are shown to other users in the rankings. Do not use your real name or contact details. Do not use names or icons that infringe others’ rights, are offensive, defamatory or discriminatory, impersonate others, or advertise. We may change, hide or delete such names or icons, or records we judge to have been obtained improperly, without notice. We may recalculate or reset rankings to fix defects.

7. Prohibited conduct

You must not: break the law; tamper with, reverse-engineer or automate the Service to obtain records or items; exploit bugs; overload or disrupt the Service; manipulate rankings with multiple accounts; buy, sell or transfer accounts, records or items; infringe the rights of others; or do anything else we reasonably consider inappropriate.

8. Suspension

If you breach these Terms, we may delete your records, remove you from rankings, suspend your use or delete your account without notice. Unused hearts will not be refunded in that case.

9. Intellectual property

All rights in the Service, including its software, design, images, text, rules and boards, belong to us or the rightful owners. The original live game “Sakugen Amidakuji” was created by Rada and supervised by dai. You may share records via the share feature and post screenshots or videos of play on your personal social media for non-commercial purposes.

10. Changes, interruption and termination

We may interrupt the Service for maintenance, failures or other unavoidable reasons. We may end all or part of the Service with reasonable advance notice in the Service. Unused hearts expire when the Service ends, except where the law requires a refund.

11. Disclaimer

We do not guarantee that the Service will work on every device, be free from defects or interruptions, never lose records, or suit any particular purpose.

12. Limitation of liability

We are not liable for damage arising from use of the Service unless caused by our wilful misconduct or gross negligence. Where the Japanese Consumer Contract Act applies and damage is caused by our ordinary negligence, our liability is limited to ordinary damage up to the amount you paid for the Service in the 12 months up to and including the month the damage occurred. These limits do not apply to wilful misconduct or gross negligence.

13. Privacy

Your information is handled in accordance with our Privacy Policy.

15. Changes to these Terms

We may change these Terms under Article 548-4 of the Japanese Civil Code. We will announce the new content and its effective date on this page and in the Service a reasonable period in advance.

16. Governing law and jurisdiction

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction in the first instance over any dispute relating to the Service.
